Marcella Burke is a partner in Eversheds Sutherland's Global Energy Practice Group and counsels clients on energy and environmental regulations and enforcement, and complex environmental corporate matters. She is a trusted advisor on matters across the energy-environmental sector spectrum, including energy technology, carbon capture, conventional oil and gas, mining, hydraulic fracturing, renewables, decommissioning, permitting, chemicals, citizen suit defense, crisis management, criminal environmental enforcement and environmental investigations. Marcella is an experienced lawyer in her field and an industry thought leader, frequently speaking on and writing about energy and environmental regulations. She's a board member of the Houston ESG Council and serves on the Executive Committee of the Environment & Natural Resources Division of the State Bar of Texas, on the Institute for Energy Law Advisory Counsel, and Chair of The Women Foundation for Natural Resources and Energy Law Environment & Natural Resources Program Committee. Prior to joining Eversheds Sutherland, Marcella was a partner at an AmLaw30 firm where she led the Houston office's Environmental Health and Safety Practice and the firm's global energy transition initiative. Prior to this role, Marcella served at the Environmental Protection Agency (EPA) as Deputy General Counsel. She also served at the Department of Interior (DOI) as Deputy Solicitor for Energy and Natural Resources, and Senior Counselor to the Assistant Secretary for Land and Minerals Management. In her roles at the DOI, Marcella was lead counsel for the Bureau of Land Management (BLM), the Bureau of Safety and Environmental Enforcement (BSEE), the Bureau of Ocean Energy Management (BOEM), and the Office of Surface Mining and Reclamation (OSMRE), all of which oversee management of federal lands, including policy and permitting for carbon capture, conventional oil and gas, renewables, mining, rulemakings, comments to proposed rules, litigation, and enforcement matters. At the DOI, she served as Counsel to the Royalty Policy Committee and received appointments with the Regulatory Reform Task Force and as National Environmental Policy Act (NEPA) team lead for all energy project approvals. In these roles, she worked closely with the Department of Justice, National Oceanic and Atmospheric Administration (NOAA), the Office of Management & Budget's Office of Information and Regulatory Affairs (OIRA), Office of Management and Budget (OMB) and other federal agencies. Prior to her time with the US Government, Marcella worked as an energy attorney at an AmLaw50 firm. Marcella clerked for the Honorable Don Willett at the Supreme Court of Texas and completed externships with the Honorable Jennifer Walker Elrod of the US Court of Appeals for the Fifth Circuit, the Honorable Nancy Atlas of the US District Court for the Southern District of Texas and the Honorable Sherry Radack of the First Court of Appeals of Texas. Marcella dedicates her spare time to a variety of volunteer and pro bono initiatives, including serving on the board of directors for Let her Play, an organization that provides programs and support to keep girls in sports, and as an ambassador for Sky High for Kids, a nonprofit that supports families whose children are undergoing treatment for cancer.
