Brooke regularly represents owners and operators, including investor-owned utilities, not-for-profit cooperatives, and other public power companies, of nuclear and electrical power plants in all aspects of litigation and commercial dispute resolution with a focus on contractor and subcontractor disputes. Brooke represents electric utilities in contract negotiations, contract disputes and litigation related to joint use and pole attachments both before regulatory commissions and traditional court settings. She also handles the general defense of contract, construction, and tort claims for a variety of clients, including construction companies, commercial property owners, utilities, and financial institutions. Brooke has experience representing clients on appellate matters both in state and federal appellate courts. Q&A Expand All Collapse All What type of matters do you work on most often? I primarily work on matters involving personal injury claims and contract disputes. I regularly represent utilities in property rights litigation during special master hearings, superior court hearings, and settlement negotiations. I also defend financial institutions and mortgage services in litigation related to quiet title claims, wrongful foreclosure claims, and claims under the Fair Business Practices Act, Fair Credit Reporting Act, Fair Debt Collection Practices Act, Real Estate Settlement Procedures Act, Truth in Lending Act, and other state and federal statutes. What do you see on the horizon in your area of practice? Many of my clients are subject to substantial state and federal laws that have recently been interpreted by courts or will soon be interpreted by courts. In their interpretation of the laws, courts are determining what obligations, if any, the laws place on my clients. These rulings, and future rulings, will significantly impact my clients' internal business practices and will continue to mold how litigation related to such laws is handled. What previous experiences, prior to your work at Balch, influence your practice? Prior to joining Balch, I clerked for a federal district court judge for two years. That job gave me excellent experience, including exposure to a broad range of litigation topics, development of my writing technique, and observation of different courtroom experiences. Select Matters Served as counsel for utilities related to the exercise of eminent domain, which included the representation of clients' interests in various court proceedings including special master hearings, and served as counsel in settlement negotiations related to the exercise of eminent domain. Obtained summary judgments in favor of mortgage servicer and financial institutions dismissing a variety of claims brought by property owners. Assisted in obtaining reversal of multi-million dollar jury verdict based on trial court's failure to require the jury to apportion damages among defaulted defendants.
