Working with Hunton Andrews Kurth's team of managed care lawyers, Thomas has defended healthcare payors in all aspects of payor-provider litigation — ERISA, Medicare, FEHBA, bad faith insurance allegations, business torts, and other claims. In one high-profile dispute, Thomas represented a pharmaceutical benefit plan in Arkansas against claims brought under Medicare Advantage regulations, successfully dismissing all claims at an early stage of the case. Thomas also stemmed the tide of Texas prompt-pay litigation alleging hundreds of millions of dollars in statutory penalties. He won dozens of summary judgments against prompt-pay penalties in state, federal, and arbitration venues, and he tried two cases to final judgment that alleged over $200 million in penalties. The arbitrators ruled in our favor on all legal issues. Thomas is a sought-after advocate. He keenly understands the value of a straightforward approach to solving difficult legal issues, acquiring this trait early on while attending law school in West Texas and clerking for Justice Phil Johnson at the Supreme Court of Texas.
