<div id="jobDescriptionText" class="jobsearch-jobDescriptionText"><div> <div> <p><b>POSITION PURPOSE</b></p> <p> This position provides transactional and regulatory support primarily to the Company's Payments and Finance teams in the negotiation of complex commercial contracts and operation of compliant, customer-focused payment and extended warranty solutions. The successful candidate must have experience serving as a subject matter expert advising on the current legal and regulatory requirements relating to all payments matters generally, ideally as applied to a retailer, including support for consumer and commercial credit products and related operational credit practices, card and payment association network rules and operations, and trade credit and other lending programs. They also must be able to identify and analyze complex legal issues, to draft and negotiate a variety of agreements and to present appropriate recommendations to minimize the legal exposure of the Company in a variety of vendor and partner contracts. Position is designated Location Flex meaning remote work is permitted 2 days/week.</p> <p><b> MAJOR TASKS, RESPONSIBILITIES AND KEY ACCOUNTABILITIES</b></p> <ul> <li> Ability to manage a robust transactional practice with a primary focus on Payments/Finance/FinTech, as well as additional adjacent transactional practice areas.</li> <li> Responsible for drafting, negotiating, and managing strategic agreements from RFP stage through contract execution and beyond.</li> <li> Provide advice and counsel regarding existing and emerging FinTech products and services.</li> <li> Accurately identify and assess contractual, business, and market risks and opportunities and advise business groups on related strategies.</li> <li> A firm grasp of key industry-wide topics, including data privacy, cybersecurity, and emerging payments technology.</li> <li> Monitor statutory, regulatory, and case law developments, assess the impact to payments-related products and services, and provide oral and written updates to impacted internal partners.</li> <li> Participate on cross-functional teams to help design financial products, identify creative solutions to unique use cases and escalated issues, and ensure compliance with applicable regulations, partner contracts, card brand rules, and other applicable laws.</li> <li> Oversee the work of outside counsel in connection with any outsourced payments-related legal work.</li> <li> Manage special projects or other department or Company initiatives.</li> </ul> <p><b><br> NATURE AND SCOPE </b><br> Reports to an Assistant General Counsel or Associate General Counsel</p> <p> Areas of specialization are Payments, Finance and General Commercial Transactions<br> <br> <b>ENVIRONMENTAL JOB REQUIREMENTS </b><br> Located in a comfortable indoor area. Any unpleasant conditions would be infrequent and not objectionable. Position is designated Location Flex, meaning remote work is permitted 2 days/week.</p> </div> <div> <p><b> MINIMUM QUALIFICATIONS</b><br> Must be eighteen years of age or older.</p> <p> Must pass a drug test.</p> <p> Must pass a background check.</p> <p> Must pass pre-employment tests if applicable.</p> <p><b> EDUCATION REQUIRED</b></p> <p> The completion of a Juris Doctorate or equivalent and required certifications for practicing law.</p> <p><b><br> YEARS OF RELEVANT WORK EXPERIENCE - 8-12 </b><br> <br> <b>PHYSICAL JOB REQUIREMENTS</b><br> Most of the time is spent sitting in a comfortable position and there is frequent opportunity to move about. On rare occasions there may be a need to move or lift light articles. <br> <br> <b>KNOWLEDGE, SKILLS, ABILITIES AND COMPETENCIES</b><br> Proven drafting and negotiation skills utilized in the course of supporting complex, strategic transactions, end-user terms and program documentation.</p> <p> Experience providing advice and counsel related to gift/stored value card programs a plus.</p> <p> The ability to work independently on numerous activities and prioritize them properly while meeting deadlines.</p> <p> The ability to confront conflict and difficult issues in a professional, assertive, and proactive manner.</p> <p> High degree of oral and written communication and analytical skills.</p> <p> The ability to work collaboratively with legal and business colleagues across multiple disciplines.</p> <p> Comfortable challenging the status-quo while abiding by our values-based culture.</p> </div> </div></div>
