Duties
The Deputy Division Counsel (Technical), Large Business & International Division (LB&I), of the Office of Chief Counsel will serve as one of two deputies to the Division Counsel (LB&I). As such, he/she assists the Division Counsel (LB&I) in the overall executive direction of the Division's domestic and international legal work and programs, with a focus on the Division's legal services for the programs of the LB&I Deputy Commissioner. Working with the Division Counsel (LB&I) and the Deputy Division Counsel (Operations), the incumbent serves as part of a management team responsible for providing strategic leadership and focus on the development and management of organizational activities, capital budgeting, and financial management and forecasting.
As Deputy Division Counsel (Technical), major duties include:- Primary responsibility for providing legal services to and working closely with the LB&I Deputy Commissioner to identify emerging domestic and international issues and transactions, appropriately coordinate those issues with the Associate Chief Counsel, and to develop plans, strategies, and policies for handling compliance challenges.
- Collaborate closely with the Deputy Division Counsel (Operations) on the resource allocations to significant non-docketed legal advice and LB&I Campaign support, and on the overall management of the Division's Litigation.
- Collaborate with other Division and Associate Offices on the development of the legal positions in non-docketed and docketed cases.
- Direct or personally perform, exhaustive and detailed research on complicated problems or cases, and review or prepare recommendations as to the position to be taken by the Division Counsel (LB&I).
- Collaborate closely with the Division Counsel (LB&I) on the most difficult, important, and complex matters arising in the administration of assigned program areas.
- Assist the Division Counsel (LB&I) in serving as a senior legal advisor to the Commissioner of Internal Revenue, LB&I Commissioner, other Division Commissioners, the Chief Counsel, and other senior IRS and Treasury officials on the legal issues confronting subchapter C corporations, subchapter S corporations and partnerships with assets greater than $10 million; and represent these officials on sensitive and controversial legal matters related to these areas.
- Assist the Division Counsel (LB&I) in serving as a principal legal advisor to the Chief Counsel, Deputy Chief Counsel(s), other Division Counsel, and other Chief Counsel and IRS executives on programs involving strategic issue identification and management, and the generation of published guidance relevant to LB&I taxpayers
- Provide executive leadership and direction to professional and support personnel through subordinate executives and managers.

Qualifications
To qualify for this position of Deputy Division Counsel, (Technical) you must meet the following requirements:
- Possess at least the first professional law degree (LL.B. or J.D.) from a law school accredited by the American Bar Association; AND
- Applicants must be an active member in good standing of the bar of a State, U.S. Commonwealth, U.S. territory, the District of Columbia, or the Commonwealth of Puerto Rico;
- Desired Education/Experience: An LL.M. in Taxation is desired but not required. 7 years of professional legal tax experience is desired.
As a basic requirement for entry into the SES, applicants must provide evidence of progressively responsible leadership experience that is indicative of senior executive level managerial capability and directly related to the skills and abilities outlined under Technical Qualifications and Executive Core Qualifications. Typically, experience of this nature will have been gained at or above the GS-15 grade level or its equivalent in Federal service. Applicants must possess the following technical and executive core qualifications:
A) Executive Core Qualifications (ECQs):
Unless you are currently serving under a Career Senior Executive Service (SES) appointment, or eligible for reinstatement into the SES, you must address the ECQs. Applicants must provide a narrative statement (not to exceed a total of 10 pages) that clearly documents and demonstrates possession of the competencies in the Executive Core Qualifications (ECQs) as established by the U.S. Office of Personnel Management. The following five ECQs provide the focus for certification of executive core qualifications for initial career appointment to the Senior Executive Service.Additional information on ECQs is available at: http://www.opm.gov/policy-data-oversight/senior-executive-service/executive-core-qualifications/ . B) Mandatory Technical Competencies (MTQs):
In addition to the Executive Core Qualifications, all candidates must show evidence of the following mandatory technical competencies in order to meet basic qualifications for this position. The narrative statements should demonstrate your specialized knowledge and technical competence. Please give concrete examples of your experience and demonstrate the complexity of the knowledge and skills you possess. You should address each MTQ separately, with the total narrative not exceeding ten pages.
Mandatory- Comprehensive, professional knowledge of and experience in applying tax laws affecting subchapter C corporations, and subchapter S corporations and partnerships with assets greater than $10 million. Also requires significant indirect experience in tax litigation, especially large case tax litigation.
- Demonstrated experience in managing all aspects of a large-scale law program that involves significant human and fiscal resources, including the ability to allocate, manage, and prioritize resources to achieve short and long term goals. Experience includes planning, directing, budgeting for, staffing, and evaluating such programs.
- Demonstrated skill in reviewing legal and non-legal documents ranging from highly complex tax documents designed for legal practitioners to non-technical/educational materials targeted for more general use.
- Demonstrated ability to review and evaluate programs for the purpose of assessing their effectiveness against overall organizational goals and objectives and the ability to design and implement program improvements as necessary to increase efficiency and enhance organizational performance.
- Must have the ability to think broadly, strategically, and long term, including the ability to translate long term goals and objectives into short term tactical plans and operational activities.
Desirable:
- A thorough understanding of the operations and organization of the Internal Revenue Service and Office of Chief Counsel, a solid understanding of the Department of the
Treasury and its Office of General Counsel, and an understanding of the role of the
Department of the Treasury Justice tax litigation are desirable.
- Direct experience with Tax litigation, especially with large case litigation is desirable
