By joining our team, you are helping to provide an experience to our stakeholders that delivers on our promises.</i></p> <p></p> <p><b> Position Summary: </b></p> <p></p> <p>At Kemper, the P&amp;C Legal Counsel group supports the Property and Casualty line of business and can be locally remote for one of our offices in Birmingham, Alabama or Dallas, Texas.</p> <p></p> <p> This attorney position acts as legal counsel for the property and casualty division of Kemper Insurance with a concentration of services provided to the claims department. The P&amp;C Legal Counsel group functions as immediately available legal counsel to the more than 3,000 claims professionals and other professionals who support the P&amp;C line of business.</p> <p></p> <p> This role will conduct legal research and analysis and render legal opinions and/or guidance that support good-faith claim-handling practices, sound claim-handling decisions that include but are not limited to review of defense and/or indemnity obligations, and the development and utilization of compliant and prudent policy provisions.</p> <p></p> <p><b> Position Responsibilities:</b></p> <ul> <li> Provide legal counsel to the Property &amp; Casualty organization, including but not limited to the following:</li> <li> Provide legal advice, coverage analysis, legal research, opinions, claim risk assessment, oversight and guidance, and recommended verbiage for letters and responses.</li> <li> Analyze claims litigation matters to provide coverage opinions regarding the company’s duty to provide a defense and/or indemnity in ongoing litigation matters for the Claims Litigation Department.</li> <li> Provide legal direction and sound judgment for the handling of high-exposure policy limit demands, in conjunction with management, to protect the interests of company’s insureds and to minimize risk of exposure to extracontractual claims.</li> <li> Provide ongoing review and analysis of insurance policy provisions, forms (including releases), and claims practices across all lines, and provide recommendations for revising/improving where appropriate.</li> <li> As assigned, support and assist in the handling of specific high-profile exposures against the company with a focus on risk mitigation and avoidance of company significant exposures.</li> <li> Participate regularly in roundtables of claims within the Property and Casualty claims organization.</li> <li> Train, support, and mentor company employees in various roles as assigned, including training in good-faith claim-handling practices.</li> <li> Effectively communicate regarding all such matters with all levels of the organization.</li> </ul> <p></p> <p><b> Position Qualifications:</b></p> <ul> <li> Law Degree from accredited law school</li> <li> Active licensure by a state bar</li> <li> At least 3+ years prior legal experience or relevant claims experience</li> <li> Ability to perform complex legal analysis and research, to analyze complex claims and legal issues thoroughly, expeditiously, and with attention to detail, and to effectively communicate legal and coverage analysis, advice, risk assessment, guidance and oversight to members of the Claims organization</li> <li> Experience conducting legal research</li> <li> Ability to work efficiently within strict time constraints to meet pertinent deadlines</li> <li> Makes decisions that have a considerable and financial consequence</li> <li> Must be able to perform routine and non-routine job functions with minimal supervision</li> <li> Some occasional travel may be required</li> <li> Understanding of good-faith claim-handling practices and extracontractual obligations is preferred, but not required</li> <li> Prior familiarity with and understanding of insurance law and practices, and with insurance coverage and form policy provisions is preferred, but not required.</li> <li> Prior understanding of legal issues, and familiarity with caselaw, legislation, and regulations in states in which the company conducts insurance business is preferred, but not required.</li> </ul> <p></p> <p><i> Kemper is proud to be an equal opportunity employer.
