This position also requires the attorney to respond and object to all governmental and civil subpoenas and investigative requests. The attorney will also provide primary legal support for the retail credit and collections team by providing legal advice, contract review, legal demand letters, and litigation support. In addition, this position requires the attorney to manage the company’s asbestos docket and will assist with contract/insurance reviews and providing general legal advice. The attorney will also be required to provide generalist support to all business units as needed regarding litigation and commercial disputes and support the Manager of Risk and Insurance on claim-related disputes and insurance coverage issues. The attorney will also providing legal advice and support to the company’s safety group regarding claims, OSHA/MSHA investigations, assistance with policy review, and advice and counsel. <div></div> <div> Job Description </div> <div> Key Accountabilities </div> <ul> <li> Provide legal counsel with regard to litigation, credit and collections matters, claims, insurance, asbestos issues, bankruptcy issues, subpoenas, government requests for information, and pre-litigation commercial disputes.</li> <li> Manage litigation matters (including management of outside counsel) and handle certain matters as first chair, including preparing witnesses, taking and defending depositions, attending hearings, attending mediations, and preparing pleadings.</li> <li> Responsible for managing eDiscovery vendors with support of outside counsel for document production and responding to discovery requests for all assigned litigation.</li> <li> Respond and prepare objections to all subpoenas and governmental requests for information.</li> <li> Manage all asbestos litigation matters.</li> <li> Provide advice, assist investigations, and support to Vistra safety department personnel as requested.</li> <li> Provide advice and support to risk management group regarding insurance and claims.</li> <li> Identify the occurrence of contract breaches and provides legal and commercial advice with regard to possible courses of action.</li> <li> Provide initial litigation and contract interpretation and analysis in the event of a contractual dispute.</li> <li> Actively monitor regulations, rules, and laws that affect the legal requirements and risk exposure of retail brands under the contracts.</li> <li> Provide legal advice regarding all personal injury and property damage claims matters.</li> <li> Provide legal advice and contract interpretation to collections personnel.</li> </ul> <div></div> <div> <div> Education, Experience, &amp; Skill Requirements </div> <ul> <li> Bachelor’s Degree, Jurisprudence Doctorate, and current license to practice law in Texas.</li> <li> Minimum of three to five years of litigation experience.</li> <li> Must have adequate computer and word processing skills.</li> <li> Strong interpersonal and communication skills, both written and verbal.</li> <li> Effective negotiation skills and experience.</li> <li> Broad based understanding of general business practices.</li> <li> Strong problem-solving abilities.</li> </ul> <div></div> <div> <div> Key Metrics </div> <ul> <li> Build and maintain an effective partnership with internal clients to identify and mitigate legal risks while achieving business objectives.</li> <li> Handle certain litigation matters, subpoenas, document productions, and claims matters as first chair to minimize costs to Vistra.</li> <li> Manage outside counsel and lead strategy for litigation, commercial disputes, and claims.</li> <li> Stay up to date on laws and legal trends in litigation in order to effectively mitigate liability to Vistra.</li> <li> Review and manage outside counsel spend in order to minimize costs to Vistra.</li> <li> Timely response to all court deadlines.</li> <li> Provide recommendations and advice to Vistra on litigation and claims.</li> </ul> </div> </div> <div></div> <div> #LI-Hybrid </div> <div> #LI-ND1 </div> <div></div> <div> Job Family </div> Legal/Compliance <div></div> <div> Company </div> Vistra Corporate Services Company <div></div> <div> Locations </div> Irving, Texas <div></div> Texas <div> <div> <div> <div> <div> <div> <div> <div> <i> We are a company of people committed to: Exceeding Customer Expectations, Great People, Teamwork, Competitive Spirit and Effective Communication.
