<div id="jobDescriptionText" class="jobsearch-jobDescriptionText jobsearch-JobComponent-description"><div> <p><b>When you join the growing BILH team, you're not just taking a job, you’re making a difference in people’s lives.</b></p> <p></p> <p><b> Job Type:</b></p> Regular <p></p> <p><b> Scheduled Hours:</b></p> 40 <p></p> <p><b> Work Shift:</b></p> Day (United States of America) <p></p> The Assistant General Counsel -Employment reports to the Senior Associate General Counsel and directly provides in-house legal services to the administration, staff, human resources department, and other employees of Beth Israel Lahey Health, Inc. (BILH) and its affiliates. The Assistant General Counsel-Employment represents BILH before courts, administrative review boards and regulatory agencies. With this backdrop, the Assistant General Counsel-Employment provides advice and counsel in the areas of employment, labor and litigation management. <p></p> <p><b> Job Description:</b></p> <p> 1. Counsel BILH and related entities on all aspects of employment relations. Advise management and clients in Human Resources on matters ranging from training and policies to negotiations and settlements.</p> <p></p> <p> 2. Represent BILH and related entities before state and federal administrative agencies, including the Massachusetts Commission Against Discrimination (MCAD) and Equal Employment Opportunity Commission (EEOC), including initial investigation and position statement response. Also manage insurance coverage and outside counsel when appropriate in such matters.</p> <p></p> <p> 3. Conduct investigations arising from employee complaints regarding workplace misconduct, including but not limited to investigations of wage and hour compliance, alleged discriminatory or retaliatory conduct.</p> <p></p> <p> 4. Counsel clients on equal employment opportunity and affirmative action efforts, including maintenance of written affirmation action plans and related activities.</p> <p></p> <p> 5. Draft and review termination letters, physician offer letters and agreements, separation agreements, and other employment related contracts.</p> <p></p> <p> 6. Make presentations and conduct trainings both inside and outside BILH and conduct teaching sessions for management, medical and professional staffs and other employees regarding relevant legal issues.</p> <p></p> <p> 7. Manage litigation and government inquiries concerning various topics related to employment law, including but not limited to ERISA, workers' compensation and immigration.</p> <p></p> <p> 8. Subpoena and summons responses, including working with department paralegal(s). General litigation advice. Maintain current knowledge of relevant employment law and advise clients about the impact of regulatory and legislative changes and guidance.</p> <p></p> <p> 9. Perform special projects pertaining to workplace issues. Work in partnership with outside law firms, directing legal work sent to such firms.</p> <p></p> <p> 10. Work collaboratively within the BILH legal group to ensure consistent delivery of legal services across the system.</p> <p></p> <p> 11. Perform other duties/tasks as assigned consistent with a lawyer with 3-6 years of experience in employ</p> <h1 class="jobSectionHeader"><b> Required Qualifications:</b></h1> <p></p> <p> 1. JD degree from an accredited institution required.</p> <p></p> <p> 2. Admitted to practice law in the Commonwealth of Massachusetts</p> <p></p> <p> 3. Must be a member in good standing to practice law in the Commonwealth of Massachusetts.</p> <p></p> <p> 4. Between 3-6 years of practice as a labor and employment lawyer with emphasis on employment law.</p> <p></p> <p> 5. Proven ability to manage legal matters with minimum oversight. </p> <p></p> <p>6. Experience with computer systems required, including web based applications and some Microsoft Office applications which may include Outlook, Word, Excel, PowerPoint or Access.</p> <p></p> <p> Preferred Qualifications:</p> <p></p> <p> 1. Experience with general litigation, labor law, compliance, OFCCP and immigration law.</p> <p></p> <p> 2.
