Overview &amp; Responsibilities MANAGER - SUPPLY CHAIN CONTRACTS ADMINSTRATION PURPOSE OF THE JOB: <ul> <li> Manage operations of Contract Administration within the Global Supply Chain and GPS Organization(s). </li> </ul> This individual will be an employee of Elliott Company (US) but will have Elliott global responsibilities for the review and negotiation of supply chain/GPS contracts. For Contract Administration: In managing this work the contract manager will be responsible for evaluating and developing negotiating strategies and training to maintain and enhance the effectiveness of the supply chain/GPS departments. The manager will also interface with suppliers, Elliott Supply Chain/GPS executives and various supply chain and GPS resources to insure effective use of the department in their contract management efforts. The manager will also review, coordinate, administer and resolve all commercial contractual terms and conditions of purchases for all products and services worldwide in line with Elliott Corporate policies in order to minimize risk and exposure to the organization. BACKGROUND and EXPERIENCE Education: <ul> <li> Law Degree/Juris Doctorate (No lapse in license); alternatively, a master’s degree in a business-related disciple with equivalent experience in sales or purchasing commercial contract law and negotiation as denoted below. </li> </ul> Experience: <ul> <li> Must have at least 10 years’ experience reviewing and negotiating complex international purchasing contracts. </li> <li> Have a background in negotiating strategy development. </li> <li> Ability to manage and motivate people on a remote basis. </li> <li> Must have a background in contract administration as well as domestic and international order administration. </li> <li> Must have strong communication and interpersonal skills. </li> <li> Must maintain legal standing by maintain proficiency through CLE. </li> <li> Must be decisive and possess strong negotiation skills. </li> <li> Must have the skills and abilities to negotiate with Corporate Officers and Attorneys, Suppliers, Customers, Supply Chain Management Leadership and Team Members. </li> <li> An appreciation of European contract law would be a definite advantage. </li> </ul> NATURE OF THE JOB <ul> <li> Supervise, develop and evaluate the Global Supply Chain and GPS Department’s team member’s capabilities in developing/negotiating strategies and effectiveness in identifying risk areas within transaction terms and conditions. Develop, implement and maintain effective programs for the review and resolution of purchasing contract language in line with Corporate Supply Chain Contract Risk Management Policies. </li> <li> Negotiate contracts with the most favorable conditions to minimize the risk of losses to the organization, while maintaining good relationships with our suppliers. </li> <li> Administer Corporate Policies and Procedures regarding contracts. Includes educating supply chain department with respect to the same. </li> <li> Administer activities covered by specific broad policies, but position often requires recognizing and resolving unusual contractual requirements which might, if unresolved, pose serious risks to the organization. </li> </ul> CONTACT WITH OTHERS <ul> <li> Internally: Senior Elliott Group executive management, Area Vice President and Managers, the Elliott Legal Department all Supply Chain/GPS personnel, Credit, Sales, Engineering, Manufacturing, Programs and other various groups as required. </li> <li> Externally: Suppliers - extensive contacts with executives and sales, Customers and other various external groups as required. </li> <li> Travel: Occasional for training and negotiations with suppliers. </li> </ul> SUPERVISION <ul> <li> Supervisor. Develop, evaluate and enhance the Supply Chain/GPS Resources capabilities in developing and negotiating strategies and effectiveness in identifying risk areas within terms and conditions. </li> </ul> Other data or description <ul> <li> Responsible for personal approval of contracts and supply chain agreements up to TBD and recommendation for approval of those in excess of TBD. </li> <li> Evaluate supply chain contract terms and conditions for contractual and legal risk and craft terms that are more focused on order risks and limit and then develop negotiating strategies to implement lower risk terms. </li> <li> Success or failure to secure favorable contracts could affect OTD, profits, and incremental future sales in addition to direct and indirect liabilities. </li> </ul> SPECIFIC JOB RESPONSIBILITIES <ul> <li> Evaluate effectiveness of supply chain/GPS departmental resources in developing negotiation strategy, handling supplier negotiation sessions and resolution of risk issues. </li> <li> Review and resolve terms and conditions on all major proposals and contracts as well as all contracts / orders requiring signed acceptance regardless of value. The aim is to identify and resolve unfavorable language. </li> <li> Negotiate with supplier representatives and / or supplier personnel, acceptable supply chain contract language. </li> <li> Complete risk assessment worksheet for Business Unit negotiation status. </li> <li> Ensure turnaround of items submitted into the contracts administration database within 10 days of receipt and monitoring relative work volume and request additional resources in times of heavy demand for services. </li> <li> Provide assistance and expertise through training when required to assist Supply Chain/GPS personnel in communicating Elliott contract requirements to suppliers. </li> <li> Establish long-term agreements with critical/strategic suppliers to help ensure best value options for Elliott Group. </li> <li> Coordinate and ensure that all proper signing authorities are observed on Supply Chain contracts. </li> </ul> Equal Employment Opportunity Ebara Elliott Energy is an equal employment opportunity/affirmative action employer and does not discriminate on the basis of race, color, religion, sex, national origin, age, marital status, genetic information, disability, veteran status, or any other characteristic protected by the federal, state or local laws of the United States.
