Respond to legal inquiries from employees and outside entities. Ensures company and subsidiary compliance with state and federal laws, regulations, and mandates. Provides experience and leadership to the staff of the Legal Department. <div> <br> Description </div> <div> <br> Provides legal advice on a range of federal and state healthcare insurance, regulatory and compliance laws, including but not limited to ERISA, MHPAEA, CAA, Medicare Advantage. Responds to employee inquiries regarding insurance and regulatory issues. Advises Audit &amp; Compliance Department on requirements, audits, and regulatory matters. </div> <div></div> <div> Researches, analyzes, and provides clear and proactive advice on privacy, security and cybersecurity issues. Represents the Legal Department on the Corporate Executive Cyber Task Force to discuss, prepare and respond to cybersecurity incidents. Answer questions related to requirements impacting the Company. Advises on proposed corporate privacy, security and cybersecurity policies and procedures. Coordinate with outside legal, vendors, and agencies as appropriate. Monitors changes in laws. </div> <div></div> <div> Supervises all aspects of e-discovery and document preservation, including electronic document preservation, collection, and review; issues and tracks legal holds; advises on legal and technological concerns relating to e-discovery. Creates and manages consistent guidelines and processes for e-discovery. </div> <div></div> <div> Monitors regulatory developments affecting the Company. Coordinates, manages and responds to federal audits (DOL, DOJ, etc.). Manages and completes various departments of insurance regulatory filings. Drafts, reviews and negotiates agreements. </div> <div></div> <div> Manages and directs legal staff, and supports department initiatives. </div> <div></div> <div> Required Education: Other Degree- Juris Doctor. SC Bar Membership. </div> <div></div> <div> Required Work Experience: 8 years of experience in the health insurance industry, privacy business or defense litigation or relevant regulatory or corporate experience. </div> <div></div> <div> Required Skills and Abilities: Strong customer service orientation. Ability to effectively communicate both verbally and in writing to all levels in the company. Excellent analytical, critical thinking and problem-solving skills. Ability to work in a highly changing environment. Ability to persuade, negotiate or influence. Ability to manage projects. Excellent presentation skills with a strong attention to detail. </div> <div></div> <div> Required Software and Tools: Microsoft Office </div> <div></div> <div> Required Licenses and Certificates: Admission to South Carolina Bar, including a rule 405 Limited Certificate of Admission. </div> <div></div> <div> Preferred Work Experience: 10 years of experience in the health insurance industry, privacy business or defense litigation or relevant regulatory or corporate experience. </div> <div></div> <div> Preferred Skills and Abilities: Ability to apply expert legal judgment to constantly changing business situations. Ability to apply judgment when applicable laws and regulations are ambiguous or unsettled. Understanding of evolving business processes. Ability to identify risks and take steps to eliminate or curtail those risks. Understanding of technology and technology law issues related to company operations.
