The COFO Paralegal will research law, investigate facts, schedule court hearings, and prepare documents to assist attorneys by performing a variety of support duties that may be assigned. They will also assist attorneys with a wide variety of tasks, including communicating with clients and loan officers and helping draft paperwork. DUTIES/RESPONSIBILITIES: Association Actions Understand and comply with the provisions of the Fair Debt Collection Practices Act and related state laws. Communicate with delinquent owners via phone, email and letter correspondence in a respectful and professional manner. Process payments from owners and prepare balance due letters, payoff letters, estoppels, etc. Prepare initial demand letters, notice of intent to foreclose letters and liens. Prepare and generate the complaint packages. Prepare and generate all foreclosure Motions. Prepare and generate Stipulations for Settlement if necessary, including the Order Ratifying the Stipulation. Prepare and generate the Motion for Summary Judgment including the affidavit of indebtedness and the affidavit of costs. The affidavit of attorney’s fees will be initially prepared and generated by the Team Assistant but will be completed by the Paralegal by confirming information is correct and by adding in the estimated attorney’s fees incurred to finish out the action. Prepare and generate all Notices of Hearing. Note — if a hearing is set and the filings are to be provided to the judge or E-filed it is YOUR responsibility to give to the Team Assistant and instruct them to provide to the judge (along with a cover letter to the court) or E-file within the time frame required by the Court. Some judges have strict requirements re: deadlines for submission of courtesy copies or E-filing prior to the hearing date and it is YOUR responsibility to make sure this is done so the hearing will go forward. NO EXCEPTIONS. Prepare and generate the Final Judgment, including the Notice of Sale. Prepare cover letter to the judge Prepare hearing folder for attorney to take to hearing. Bank Actions Pull Mortgage/Satisfaction Search Prepare Answer/Affirmative Defenses. Prepare and generate any Motions for Case Management Conference, Notice of Trial, Motions to Reschedule Sale, etc. Prepare and generate all Notices of Hearing. Closing files Paralegal must make sure all legal work is complete for file to be closed and that there are no outstanding invoices to be paid. If there are outstanding, invoices, determine if there is money in trust to pay the invoice. Give file to the team assistant to prepare check request, or if no money in trust, to prepare the additional funds request. If there is money in trust for another matter, contact Association to obtain consent to use funds for payment of the invoice. Matter Centricity: Receive Court Pleadings filed. Save the document in the file through filesite for further profiling by file clerk. REQUIRED SKILLS/ABILITIES: Must be proficient in software tools, including but not limited to Word, Excel, Outlook, and the Internet. Must possess strong written and verbal communications skills. Must provide excellent customer service to internal and external customers Identifies and solves issues in a timely manner. Must be a team player and willing to help others in their department whenever necessary. Must be extremely organized and be able to multi-task. Conscientious with respect to work completion, deadlines, time management and attendance. Analytical and detail oriented, while working at a fast pace and capable of multi-tasking.
