When considering candidates, we look for scientific and business professionals who are highly motivated, collaborative, and most importantly, share our passionate interest in fighting cancer. </div> <div></div> <div> General Description: </div> <div></div> <div> The Privacy Counsel, ex-APAC will lead privacy legal matters outside the Asia Pacific region (ex-APAC), with special focus on the Company’s United States (US), European and new markets operations. </div> <div></div> <div> Reporting to the Director, Privacy, ex-APAC, this newly created role will serve as the Company’s privacy lead lawyer for privacy legal matters outside the Asia Pacific region (ex-APAC) and will play a critical role in leading the development and implementation of legal privacy strategies, particularly in what concerns to R&amp;D functions. </div> <div></div> <div> In addition, this role will work with other members of BeiGene’s Legal and Compliance and IT teams on data privacy and security-related matters, including auditing and monitoring activities, investigations and data incident responses, responses to data subject requests, and the design of scalable technology solutions and tools to support the continued growth of BeiGene with its existing operations in the United States, Europe, and in new markets and regions. </div> <div></div> <div> The position may be based in BeiGene’s Switzerland (Basel), or Massachusetts (Cambridge) office locations. Remote work in the U.K. or other locations to be considered only on a case-by-case basis. </div> <div></div> <div> Essential Functions of the job: </div> <ul> <li> <div> In coordination with members of the Legal Department, monitors and maps requirements of existing and new ex-APAC privacy laws and enforcement actions, and proposes changes to be implemented by Privacy Officer ex-APAC. </div></li> <li> <div> Advises ex-APAC business on complex matters and questions related to interpretation and compliance with privacy legal requirements and internal privacy policies and procedures. </div></li> <li> <div> Ensures effective coordination with APAC Privacy Team and members of the APAC Legal and Compliance on the implementation of the global privacy program. </div></li> <li> <div> In collaboration with members of the Legal Department, advises Privacy Officer ex-APAC on country privacy obligations, e.g., those related to: </div> <ul> <li> <div> Interactions with privacy regulatory authorities; </div></li> <li> <div> Data subjects' rights; </div></li> <li> <div> Work councils; </div></li> <li> <div> Data breaches. </div></li> </ul></li> <li> <div> Center of excellence/ escalation point for ex-APAC contracts counsel and R&amp;D functions on privacy legal matters, related to: </div> <ul> <li> <div> Data processing agreements; </div></li> <li> <div> Data privacy addendums and clauses for MSAs, MCONs, CTAs; </div></li> <li> <div> International data transfer agreements; </div></li> <li> <div> Privacy and security clauses for global, regional and country ICFs and Protocols. </div></li> </ul></li> <li> <div> Drafts regional templates of data privacy clauses, privacy notices and privacy consent forms to be deployed on a country level by the members of the Legal Department. </div></li> <li> <div> Together with ex-APAC Legal department localize regional templates into country or state templates. </div></li> <li> <div> Makes available ex-APAC playbooks, FAQs, and standard responses to EC/DPA inquiries. </div></li> <li> <div> In collaboration with Privacy Officer ex-APAC, provides training on data privacy matters to Business and Colleagues in the Legal Department. </div></li> <li> <div> In coordination with colleagues in the Legal Department, represents BeiGene on regional and R&amp;D industry forums related to privacy, e.g. International Pharmaceutical and Medical Devices Privacy Consortium (IPMPC). </div></li> </ul> <div></div> <div> Requirements: </div> <ul> <li> <div> Juris Doctorate (JD) or equivalent, with lAPP certifications such as CIPP/US, CIPP/IT or CIPP/M preferred. </div></li> <li> <div> A minimum of six years of experience working full-time in privacy, with at least four in the bio-pharmaceutical industry and/or advising the bio-pharmaceutical industry in a nationally recognized law firm or consulting practice. </div></li> <li> <div> Experience in managing people. </div></li> <li> <div> Strong working knowledge and experience with privacy and data protection laws (e.g., GDPR, CCPA and HIPAA). </div></li> <li> <div> Excellent written / verbal communication skills and presentation skills in English. </div></li> <li> <div> Demonstrated ability to build and maintain solid relationships / connections across the organization. </div></li> <li> <div> Ability to work independently as well as collaboratively with enthusiasm and accountability. </div></li> <li> <div> “Customer First” customer service orientation - puts the customer at the center of all business activities. </div></li> </ul> <div></div> <div> Supervisory Responsibilities: </div> <ul> <li> <div> Yes </div></li> </ul> <div></div> <div> Computer Skills: </div> <ul> <li> <div> PC, including MS Office Suite </div></li> </ul> <div></div> <div> Travel: </div> <ul> <li> <div> 10% to 25%, or more if working remotely </div></li> </ul> <div></div> <div> Competencies: </div> <div> Ethics - Treats people with respect; Inspires the trust of others; Works with integrity and ethically; Upholds organizational values. </div> <div></div> <div> Completes administrative tasks correctly and on time.
