<b>What You Will Do</b> <br> <br> <b>This position will be filled at either the Attorney 3/4 level, depending on the skills of the selected candidate. Additional job responsibilities (outlined below) will be assigned if the candidate is hired at the higher level.</b> <br> <br> Seeking an experienced attorney to serve as an employment attorney in the Litigation and Employment Law Group for Los Alamos National Laboratory (LANL), managed and operated by Triad National Security, LLC for the National Nuclear Security Administration (NNSA). Responsibilities will include providing legal advice to management on a wide variety of personnel issues, including civil rights and employment discrimination matters; disciplinary matters, benefits and immigration issues; training management on legal matters relating to personnel issues; advising Triad in connection with labor matters, including collective bargaining and day-to-day labor disputes; representing Triad or supporting Triad's litigation counsel in employment-related matters before government agencies (e.g., EEOC, NM HRB charges) or in administrative hearings, arbitrations, and other legal proceedings; and providing legal advice to management on other personnel-related legal issues. <br> <br> The selected candidate will collaborate closely with LANL's Human Resources Division and work closely with all members of management on personnel legal issues. Moreover, the individual will serve as a primary interface on labor, employment, benefits, and immigration matters with the NNSA. <br> <br> <b>Attorney 3 ($135300- $227700)</b> <br> <ul> <li> Responsibilities for this role include, but are not limited to, the following:</li> <li> Serve as a legal subject matter expert in laws relating to discrimination and harassment (e.g., Title VII, FMLA, ADA, ADEA, New Mexico Human Rights Act), wage and hour (e.g., FLSA), labor (e.g., NLRA), benefits, immigration, and other employment-related laws and regulations. </li> <li>Draft, review, analyze and provide advice/guidance on legal and institutional documents, including personnel policies, contracts, and management directives.</li> <li> Develop a proactive plan to help ensure compliance with employment-related laws in all jurisdictions where Triad has employees, including monitoring and advising stakeholders on changes in the law.</li> <li> Practice preventive law by anticipating legal issues that may arise, and work with clients to develop and implement strategies to minimize risk to Triad and avoid costly legal disputes. </li> <li>Train and provide an educational overview of applicable areas of law to management and employees, including information on industry practices and regulatory changes.</li> <li> Research and evaluate information regarding industry practices or applicable regulatory changes affecting LANL policies or programs in connection with recommending sound, practical solutions to complex issues. </li>Understand and adhere to all LANL policies, procedures, and industry regulatory guidance and governance specific to the Office of General Counsel. </ul> <br> <br> <b>Attorney 4 ($146800 - $254700)</b> <br> <br> In addition to what is outlined at the lower level, at this level you can expect to perform the duties above more independently. You will also mentor other attorneys in areas of employment, labor, benefits, and immigration. <br> <br> <b>What You Need</b> <br> <br> <b>Minimum Job Requirements: </b> <br> <br> <b>Legal Expertise</b> <br> <br> You will need to have significant experience practicing law in the areas of discrimination and harassment (e.g., Title VII, FMLA, ADA, ADEA, New Mexico Human Rights Act), wage and hour (e.g., FLSA), labor (e.g., NLRA), and other labor- and employment-related laws and regulations. <br> <br> <b>Legal &amp; Institutional Documents</b> <br> <br> You must have some experience with drafting, reviewing, analyzing, and providing advice/guidance on legal and institutional documents, including personnel policies, contracts, and management directives. <br> <br> <b>Client Interactions </b> <br> <br> We are looking for someone with the ability to interact with all levels of staff and management, establishing productive working relationships, and providing constructive advice on a variety of employment law issues. <br> <br> <b>Proactive Practice</b> <br> <br> You will need to have the ability to anticipate legal issues that may arise, and work with clients to develop and implement strategies to minimize risk. <br> <br> <b>Education/Experience</b> <br> <br> Position requires a Juris Doctorate Degree from an American Bar Association (ABA) accredited law school, being in good standing with the State Bar of New Mexico or another state bar, with the expectation of being authorized to practice law in New Mexico within a year of hire, and at least seven years of legal experience after passing the bar exam and being admitted to practice. <br> <br> <b>Additional Job Requirements for Attorney 4</b> <br> <br> <b>Legal Expertise</b> <br> <br> You will need to have expert-level experience practicing law in the areas of discrimination and harassment (e.g., Title VII, FMLA, ADA, ADEA, New Mexico Human Rights Act), wage and hour (e.g., FLSA), labor (e.g., NLRA), and other labor- and employment-related laws and regulations. <br> <br> <b>Legal &amp; Institutional Documents</b> <br> <br> You must have extensive experience with drafting, reviewing, analyzing, and providing advice/guidance on legal and institutional documents, including personnel policies, contracts, and management directives. <br> <br> <b>Client Interactions </b> <br> <br> We are looking for someone with the demonstrated ability to interact with all levels of staff and management, as well as having established productive working relationships and provided constructive advice on a variety of employment law issues. <br> <br> <b>Proactive Practice</b> <br> <br> You will need to have a history having anticipated legal issues that may arise, and having worked with clients to develop and implement strategies to minimize risk. <br> <br> <b>Education/Experience:</b> Position requires a Juris Doctorate Degree from an ABA accredited law school, being an active member of a bar in good standing with the State Bar of New Mexico or another state bar, with the expectation of being authorized to practice law in New Mexico within a year of hire, and at least 12 years of legal experience after passing the bar exam and being admitted to practice. <br> <br> <b>Desired Qualifications: </b> <br> <br> <b>Experience in Personnel and Employment Related Legal Areas</b> <br> <br> Triad engages in a wide variety of personnel related legal issues, and expertise in any other such areas could be helpful to the candidate's application, including, in particular, employee benefits law (including ERISA) and immigration law, although knowledge and experience in such areas is not a requirement for the selected candidate. <br> <br> <b>Performance Behaviors</b> <br> <br> In the Office of General Counsel how we work is just as important as what we work on. Hybrid is at the discretion of management and can change at any time with appropriate notice. <br> <br> <b>Position commitment:</b> Regular appointment employees are required to serve a period of continuous service in their current position in order to be eligible to apply for posted jobs throughout the Laboratory. Please note that this requirement applies only to citizens of the United States. Foreign nationals are subject to a similar requirement under DOE Order 142.3A. <br> <br> <b>Clearance: Q </b>(Position will be cleared to this level). Selected applicants will be subject to a background investigation conducted by or on behalf of the Federal Government, and must meet eligibility requirements* for access to classified matter. This position requires a Q clearance. and obtaining such clearance requires US Citizenship except in extremely rare circumstances. Dependent upon the position, additional authorization to access classified information may be required, which may or may not be available to dual citizens. Receipt of a Q clearance and additional access authorization ultimately is a decision of the Federal Government and not of Triad. <br> <br> <ul> <li>Eligibility requirements: To obtain a clearance, an individual must be at least 18 years of age; U.S. citizenship is required except in very limited circumstances. See DOE Order 472.2 for additional information.</li> </ul> <br> <b> New-Employment Drug Test:</b> The Laboratory requires successful applicants to complete a new-employment drug test and maintains a substance abuse policy that includes random drug testing. Although New Mexico and other states have legalized the use of marijuana, use and possession of marijuana remain illegal under federal law.
