Job Description: Represent clients in patent prosecution matters, including working with inventors and reviewing invention disclosures in Mandarin and English; preparation and filing of patent applications with the U.S. Patent and Trademark Office (“USPTO”); analyze complex patent issues, including patentability, patent eligibility, validity, infringement, inducement, divided infringement, damages, and willfulness; perform due diligence, freedom-to-operate, and patentability analyses; conduct patent research; perform complex technical analyses in the pharmaceutical and biomedical arts; conduct Examiner interviews at the USPTO; prepare and file patent applications and Office Action responses and other necessary documents with the USPTO; supervise junior attorneys, technology specialists, and patent agents; partner with other attorneys to protect intellectual property rights for clients; research, review and/or analyze prior art for relevance to client technologies; prepare concise, accurate, and relevant technical arguments and/or analyses in line with fundamental intellectual property concepts; follow ethical requirements as set forth by the Rules of Professional Conduct of the state bar; perform tasks to budget; review and analyze newly assigned and existing matters in order to provide legal representation until matter is concluded; interact with client and ex-U.S. counsel in managing prosecution of the client’s patent portfolio throughout the world; draft all necessary documents to provide legal representation to clients; perform necessary legal research using all available resources including libraries and computer data systems; formulate and issue well-founded legal opinions to clients; effectively conduct negotiations to resolve matters on behalf of clients; advise and communicate regularly with Chinese clients in written and spoken Mandarin and English regarding the status of their matters, including regarding patent prosecution and freedom to operate; and maintain membership in state bar and complete all required Continuing Legal Education requirements on an annual basis. Job Requirements: Juris Doctor (JD) and three years of experience in patent litigation. Must also possess a Doctor of Philosophy (PhD) in Molecular Biology, Genetics, or Immunology. Must be licensed to practice law in California. Must be eligible to sit for the USPTO examination. Must have at least three years of experience working in patent litigation at a private law firm Must have ability to read, write, and speak Mandarin and English fluently.
