In connection therewith, Sunlight has certain obligations in respect of processes for underwriting and compliance with applicable consumer protection laws.<br> A naturally extending risk of Sunlight’s business is the prospect that unsatisfied or aggrieved borrowers will attempt to obtain a remedy by suing Sunlight and/or the lenders in Sunlight’s network. Given the Sunlight’s current litigation and arbitration portfolio and Sunlight’s desire to give appropriate attention to all consumer grievances, Sunlight desires to hire an experienced litigation attorney to: (a) manage and direct all of Sunlight’s litigation and arbitration cases and provide experienced counsel in connection therewith; (b) manage and direct all of Sunlight’s governmental or regulatory investigations; and (c) work cooperatively with, and manage relationships with, outside counsel.</p> <p></p> <p><b><br> What you will be doing:</b></p> <ul> <li> Act as litigation counsel for Sunlight with responsibility for the management of all consumer, corporate, regulatory, commercial, and other litigation;</li> <li> Manage all aspects of litigation and pre-litigation disputes and partner with other departments to investigate borrower claims and develop resolution strategies;</li> <li> Develop and implement Sunlight’s litigation strategies;</li> <li> Provide informed cost-benefit analysis when identifying risks and select and recommend alternative methods of dispute resolution, when appropriate;</li> <li> Identify potential litigation or regulatory risk and counsel the business regarding the degree of risk exposure;</li> <li> In partnership with other members of the Legal and Compliance Department, proactively set and execute legal strategies anticipating and addressing changes in laws, regulations and the business environment to the advantage and benefit of the Company.</li> <li> Help develop and implement creative approaches regarding the management of the litigation budget;</li> <li> Attend mediations, arbitrations and direct settlement discussions on behalf of Sunlight.</li> </ul> <p></p> <p><br> As a member of the current 4 person legal and compliance team, the litigation attorney will initially report to the Managing Director, Associate General Counsel – Head of Commercial Legal. The position will be based in Charlotte, NC.</p> <ul> <li> 7+ years of law firm or in-house litigation experience with demonstrable levels of increasing responsibility</li> <li> Extensive litigation experience with consumer protection laws</li> <li> Proven track record of successfully managing complex litigation</li> <li> Strong research, writing, analytical, and advocacy capabilities – must be able to present and explain legal defense strategies and documents to executives and other stakeholders</li> <li> Experience with arbitration and mediation preferred</li> <li> Serve as the primary advisor for legal hold issues, e-discovery, and subpoenas</li> <li> Self-starter with an intellectual interest in Sunlight’s business and operations that inform the legal issues arising in Sunlight litigation matters</li> <li> Experienced business lawyer and strategic negotiator</li> <li> Ability to handle matters directly or to efficiently direct the participation of external counsel when necessary</li> <li> Collaborative workstyle</li> <li> Strong communication skills and ability to execute with minimal supervision</li> <li> Juris Doctor required, with a valid license to practice law in any state</li> </ul> <p></p> <p><b><br> At Sunlight Financial, we value diversity and inclusion.
