ROLE DESCRIPTION DigiCert’s mission is to create and support relationships of trust in the digital world. As part of that mission, we are committed to building a best- in-class data privacy program and are looking for Privacy Counsel to play an integral part in that effort. You will be DigiCert’s expert on data privacy regulations, compliance requirements and best practices around the world. You will advise the operations managers of our data privacy program and assess the compliance of the program with applicable law and standards and help identify gaps and areas for improvement. You will report to DigiCert’s Vice President/Associate General Counsel, Privacy & Employment. PRIMARY RESPONSIBILITIES Strive for/maintain expertise in global data privacy law Be aware of worldwide legal developments in data privacy and related areas Research data privacy-related legal topics Advise privacy program management on compliance requirements and best practices Assess and benchmark DigiCert’s data privacy compliance efforts and recommend measures to improve program elements and remedy gaps Inform and train management and other stakeholders on data privacy compliance requirements and related topics Negotiate and draft customer and vendor privacy agreements Train customer and vendor contracts personnel on dealing with contractual privacy terms and issues Draft privacy notices and policies, training materials, memoranda, white papers, data sheets and other privacy-related documents Respond to customer questionnaires and requests for information about DigiCert privacy compliance Understand DigiCert products, technologies, customer relationships and internal processes to better understand and advise on data privacy matters Advocate for privacy responsibility and Privacy by Design in DigiCert products and programs Assist in responding to non-routine complaints and concerns raised by customers, regulators and other data subjects Communicate with and respond to government regulators regarding privacy matters Assist with formal privacy complaints and privacy litigation Advise and train on data breach readiness and response, including drafting and helping implement policies and procedures and guiding tabletop exercises and simulations Interface with and manage outside privacy counsel, consultants and auditors Prepare data breach reports, as necessary, and provide communications and guidance on dealing with data incidents Help promote and represent DigiCert data privacy interests in public and industry forums through drafting and commenting on articles, news items, social media posts, webinars, white papers, etc. Perform other duties as required or assigned ROLE REQUIREMENTS J.D. At least 3-5 years’ experience in advising clients or managing in-house compliance efforts in at least one area of substantive legal expertise Very strong writing and legal document/policy drafting skills Strong written and verbal advocacy skills Self-motivated and focused on learning and developing skills and expertise Diplomatic and interpersonal skills ABOUT YOU **You have and exercise good judgment:** You recognize the importance of data privacy compliance, but you also have the judgment to understand its place in a company with many competing objectives Among all the possible compliance objectives and controls you can recognize and focus on what’s most important to mitigate company risk You are comfortable working independently and collaborating with a team You are eager to learn and improve your expertise and general knowledge You are a tech-savvy self-starter with great problem-solving skills You are humble and willing to take direction and learn from others, and in turn share your knowledge in a respectful manner—a “learn-it-all,” not a “know-it-all” You are organized, responsive, and persistent with good follow-through You have the ability to develop great rapport with others BONUS EXPERIENCE Law firm or large legal department experience Experience with project management Working expertise in at least one and familiarity with a wide range of privacy law and regulation around the world Expertise in/familiarity with non-legislative privacy frameworks and standards (i.e., NIST, GAPP, ISO) Privacy certification such as CIPP Knowledge or experience with digital certificate industry WORK LOCATION Lehi, Utah DIGICERT BENEFITS DigiCert offers a competitive benefits package for all of our full-time employees.
