From advocating for seat belts, air bags and graduated driving laws, to being an industry leader in pricing sophistication, telematics, and, more recently, device and identity protection.</p> <p></p> <p><b> Job Description</b></p> The Litigation Services Attorney job family is responsible for representing the Company in Insurance Defense Matters and other Disputes and Litigation commenced by and against the Company. <br> <br> The ideal candidate for this role will have a passion for combatting fraud against the insurance industry. In this role, you will utilize your strong No-Fault/SIU background to help defend against fraudulent claims filed against The Company and to bring Affirmative Actions, including RICO based litigation on behalf of The Company, Attendance at hearings, arbitrations, mediations, and trials in state and federal courts is required. Strong legal writing skills are essential. Conducting research, substantive drafting, and reviewing, advising, and negotiating on more complex matters is also required. <p></p> <p><b> Key Responsibilities:</b></p> <ul> <li> Partner with our Claims/SIU department to defend against fraudulent claims submitted against The Company in No-Fault and other matters</li> <li> Prepare, file and litigate fraud actions on behalf of the Company including RICO and other Affirmative Actions</li> <li> Prepare litigation strategies in complex matters</li> <li> Defend The Company in No-Fault litigation related to fraud</li> <li> Review file assignments, and strategize for resolution</li> <li> Propound discovery and drafts motions, memorandums and other legal briefs as required</li> <li> Prepare for and conduct depositions and EUOs</li> <li> Attend arbitrations, mediations, and trials including expert witnesses</li> <li> Prepare and conduct court appearances (matter management conferences, hearings, status conferences, etc.), in both State and Federal Court</li> <li> Draft pre and post-trial motions in Federal and State Courts</li> <li> Negotiate settlement and draft related documents</li> <li> Prepare and argue appeals</li> <li> Provide legal opinions to Claims</li> </ul> <p></p> <p><b> Knowledge/Skills/Abilities/Experience:</b></p> <ul> <li> Core Competencies <ul> <li> Intermediate skills/abilities/experiences in the following areas: legal knowledge, including No-Fault Laws, knowledge of WC Fee Schedule, Health Care Laws applicable to pursuing and handling SIU matters, business knowledge, issue management, analytical skills, influencing others, coaching and development, self development, and productivity</li> </ul></li> <li> Other Requisites <ul> <li> Possesses a juris doctorate and a license to practice law in MI</li> <li> Federal Court admission</li> <li> 7+ years related experience typical in SIU/No-Fault</li> <li> Federal Court experience strongly preferred.</li> <li> Ability to manage Complex Litigation cases</li> <li> Computer skills, including MS Office suite, used in or related to the tasks performed</li> <li> Exercises discretion and maintains confidentiality of sensitive information</li> <li> Demonstrates ethics and integrity</li> <li> Has relevant experience within a reputable law firm or an in-house legal department for a mid- to large-sized organization</li> <li> Insurance-industry experience preferred</li> <li> Knowledge of legal holds and discovery processes</li> </ul></li> <li> Management &amp; Supervisory Skills <ul> <li> Budget management skills</li> <li> Project management skills</li> <li> Able to interact with all levels of personnel and supervise/oversee the work of more junior resources</li> <li> Utilizes subject matter expertise to coach and guide less experienced team members</li> </ul></li> </ul> <p></p> <p> ***Location: This is a remote position in Michigan.
