The Counsel role is a full-time (40 hours per week) salaried position designed to be flexible on location, including working from home with access to any of our local offices as needed. This is for experienced lawyers who do not seek to be in a partner-track position, but who want to continue to do sophisticated legal work and have direct client involvement. Candidates should have 7+ years of increasingly responsible employment law experience, preferably on the defense side, and be excited to work on a collaborative and innovative team, delivering high-quality work and identifying technological and creative ways to maximize efficiencies for single-plaintiff employment litigation. As Counsel, candidates must be very comfortable handling a single-plaintiff employment lawsuit from start to finish with minimal oversight. In this role, Counsel will routinely interface directly with clients and Firm partners, as well as provide litigation recommendations and develop defense strategy. Legal Responsibilities: A Counsel is responsible for leading, managing, and/or supporting legal matters relating to Single-Plaintiff Litigation and Administrative Charges. Lawyers in this role will handle matters in federal and state courts, and before the Equal Employment Opportunity Commission, and perhaps the Department of Labor, as well as other federal, state, and local administrative agencies, with minimal oversight. They will have the ability to handle a practice that includes both overseeing EEOC Charges, including defending investigations, preparing position statements, defending clients in fact-finding conferences and on-site visits, representing clients in mediations and conciliations, and negotiating settlements, as well as directly managing single-plaintiff litigation, including drafting responsive pleadings, handling all aspects of the discovery process (including taking and defending depositions), drafting motions and briefs, including motions for summary judgment, attending and handling arbitrations, and, where appropriate, delegating such work to and reviewing the work of more junior attorneys. Occasional travel, both in-state and out-of-state, may be required. A Counsel will be dedicated to a limited number of client portfolios of employment work, such that the lawyer will become immersed in the business needs of a particular industry or industries and will be able to develop a deep knowledge of a client’s preferences, as well as grow the client relationship. The Counsel will be responsible for handling and litigating such clients’ portfolios within a particular geographic region, in addition to working directly with the relevant relationship partners to foster a stronger client relationship.
