As the attorney for property management, you will play a critical role in managing legal matters related to our property management operations, with a primary focus on fair housing issues, litigation, insurance matters, and evictions. Your expertise will ensure our company's compliance with all relevant laws and regulations, while safeguarding our assets and interests.</p> <p></p> <p><b> Key Responsibilities: </b></p> <p></p> <p><b>Eviction Proceedings:</b></p> <ul> <li><p> Oversee and help coordinate outside counsel in connection with eviction proceedings in accordance with applicable laws.</p></li> <li><p> Provide legal counsel on tenant-related issues and ensure proper documentation for evictions.</p></li> <li><p> Conduct eviction training for employees and management staff.</p></li> <li><p> Develop and maintain eviction policies and procedures in compliance with local laws.</p></li> <li><p> Assist with audit related functions for evictions.</p></li> </ul> <p></p> <p><b> Fair Housing Compliance: </b></p> <ul> <li><p>Provide guidance and oversight to ensure the company's compliance with all federal, state, and local fair housing laws and regulations.</p></li> <li><p> Review forms of tenant applications, forms of lease agreements, and policies to ensure they adhere to fair housing requirements.</p></li> <li><p> Conduct fair housing training for employees and management staff.</p></li> <li><p> Work with and help manage outside counsel to investigate and address any fair housing complaints or allegations promptly and effectively.</p></li> <li><p> Be a resource for Risk Management and Operations on Affirmative Fair Housing Marketing Plans for each property in the portfolio.</p></li> <li><p> Assist Risk Management with reasonable accommodation requests.</p></li> <li><p> Assist Risk Management with credit/criminal application reconsideration requests.</p></li> </ul> <p></p> <p><b> Insurance and Litigation Matters:</b></p> <ul> <li><p> Assist in the resolution of insurance claims and other pre-litigation disputes.</p></li> <li><p> Work with outside insurance defense counsel to investigate and address claims and disputes covered by insurance.</p></li> <li><p> Manage the Director of Risk Management and her team in connection with processing insurance claims.</p></li> <li><p> Stay updated on insurance industry trends and recommend adjustments to insurance strategies as needed.</p></li> <li><p> Assist Risk Management, Operations, and other business partners with deposition preparation.</p></li> </ul> <p></p> <p><b> Legal Research and Analysis:</b></p> <ul> <li><p> Stay informed about changes in relevant property management laws, regulations, and industry best practices.</p></li> <li><p> Conduct legal research and provide clear and concise legal opinions and recommendations to company management.</p></li> <li><p> Assist in the development and implementation of legal strategies to mitigate risk and improve operations.</p></li> </ul> <p></p> <p><b> Contract Management: </b></p> <ul> <li><p>Review and negotiate contracts related to property management, including property management agreements, vendor agreements, lease agreements, service contracts, NDAs, and utility agreements.</p></li> <li><p> Ensure contracts are compliant with relevant laws and align with the company's goals and objectives.</p></li> <li><p> Provide guidance on contract disputes and resolutions.</p></li> </ul> <p></p> <p><b> Additional Items:</b></p> <ul> <li><p> Added benefit if candidate has experience with the following:</p></li> </ul> <ul> <li><p> Employee and resident related fraud</p></li> <li><p> Privacy law</p></li> <li><p> ADA compliance</p></li> <li><p> Licensing related knowledge</p></li> <li><p> HR related legal issues</p></li> </ul> <p></p> <p><b> Qualifications:</b></p> <ul> <li><p> Juris Doctor (JD) degree from an accredited law school and active state bar membership.</p></li> <li><p><b> Minimum of 5 years</b> of relevant legal experience, preferably in property management, real estate, or related fields.</p></li> <li><p> Strong understanding of fair housing laws, litigation, dispute resolution, insurance regulations, and eviction procedures.</p></li> <li><p> Excellent negotiation, communication, and analytical skills.</p></li> <li><p> Ability to work independently and collaboratively, demonstrating strong problem-solving abilities.</p></li> <li><p> Detail-oriented with exceptional organizational skills.</p></li> <li><p> Proficiency in legal research and analysis.</p></li> <li><p> Knowledge of property management software and systems is a plus.</p></li> <li><p> Travel every other month</p></li> </ul> <p></p> <p><b> The NRP Group is committed to a policy of assuring that all employees and applicants for employment are recruited, hired, assigned, placed, transferred, demoted, laid off, terminated, paid, trained, and generally treated during employment on the basis of qualifications and merit;
