Deputy General Counsel</li> <li>Manage both offensive and defensive commercial, employment and insured claims and litigated matters. </li> <li>Formulate and drive strategy on pending and threatened claims and litigation.</li> <li>Supervise and partner with outside counsel to ensure that all aspects of legal representation of the Company are of the highest quality and provide day-to-day management of all aspects of matters, including strategic and tactical decision-making and critical review of written work product.</li> <li>Investigate, and actively manage or directly handle local, state and federal agency inquiries, investigations or actions involving compliance or other regulatory issues.</li> <li>Investigate, assess and advise on or directly respond to pre-litigation claims and disputes; Provide practical advice on risk, claim, litigation and regulatory issues to internal teams.</li> <li>Assess operational policies, processes and practices to identify, evaluate and mitigate claim and litigation risk; Work closely with the business leaders to ensure that company policies and procedures are in compliance with current laws and are being followed by the Company.</li> <li>Support the HR function with respect to employment and labor law.</li> <li>Partner with HR and business managers to manage risk and provide employment law advice and counseling regarding employees.</li> <li>Establish and manage budgets.</li> </ul> <p><b><i>Duties and Responsibilities:</i></b></p> <ul> <li>Develop a comprehensive understanding of the Company’s organizational structure, business operations and policies &amp; procedures in order to identify and assess areas of risk, defend claims and litigation, and counsel &amp; advise business management on matters of risk mitigation and dispute resolution.</li> <li>Maintain substantive knowledge of statutes, regulations, precedential law and procedural rules associated with employment, construction, tort, contract, commercial and product liability litigation.</li> <li>Directly handle or work with outside counsel to defend the Company in various types of litigation, including but not limited to, developing strategy, preparing/reviewing pleadings and motions, participating in depositions, attending hearings, assessing potential exposure, and recommending appropriate reserves.</li> <li>Closely manage outside counsel to control and reduce litigation fees, costs and related expenses.</li> <li>Provide regular reports to Vice President &amp; Deputy General Counsel regarding the status of litigation and claims, recovery initiatives and other matters.</li> <li>Develop and deliver training programs to facilitate compliance, educate business team members and reduce the risk of future claims and/or litigation.</li> <li>Advise HR professionals and business managers regarding employment-related matters under US federal state and local laws.</li> <li>Advise on matters related to Labor Relations issues and provide oversight and guidance as requested for grievances arbitration and negotiations and able to develop strategies that minimize risk for the organization.</li> <li>Advise HR professionals on emerging legislative and regulatory changes affecting employment and labor obligations and assist in the creation of policy procedures and training to support the implementation of compliance measures.</li> <li>Review and revise internal policies and procedures to ensure multi-jurisdictional regulatory compliance.</li> <li>Advise HR and assist negotiating employment-related documents including separation agreements and restrictive covenants.</li> <li>Provide legal representation and/or oversee outside counsel regarding agency administrative charges audits and investigations (e.g., EEOC DOL OSHA and state/local agencies).</li> <li>Respond to attorney letters complaints and claims involving employment and labor related concern.</li> <li>Support HR professionals on compensation benefits ERISA and immigration matters.</li> <li>Formulate legal policies, procedures, and objectives related to employee relations and employment law.</li> <li>Provide senior management with expert legal advice and substantive recommendations regarding employee conduct standards, investigations of misconduct, and proposed disciplinary actions.</li> <li>Provide legal review of grievances and other employee complaints, claims, allegations and issues of entitlement.</li> <li>Review for legal sufficiency proposed adverse actions, other disciplinary measures, and other personnel actions based on misconduct and performance.</li> <li>Travel at least 15% to successfully fulfill the duties of this position.</li> <li>Perform such other duties as requested by the Vice President &amp; Deputy General Counsel.</li> </ul> <p><b><i>Education:</i></b></p> <ul> <li>J.D. degree from a leading law school, with excellent academic credentials</li> <li>Member in good standing, of at least one US state bar. If licensed outside the State of Florida, admission to the Florida Bar as In-House Counsel may be required.</li> </ul> <p><b><i>Experience</i></b>:</p> <ul> <li>A minimum of 12 years litigation experience (preferably a mix of commercial, employment, construction and tort). This may include relevant law firm, in-house and/or government experience.</li> <li>A minimum of 5 years’ experience providing advice and counseling to HR business clients at various levels of an organization.</li> <li>Mediation, arbitration and trial experience required. Extensive experience with motion practice, preparation and review of pleadings, taking and defending depositions, and oral argument.</li> <li>Familiarity with eDiscovery requirements, technologies and issues, including document retention policies and procedures as well as collection, review, and production of documents.</li> <li>A firm understanding of relevant compliance rules and requirements, including the laws and regulations governing U.S. companies, as well as an appreciation of pertinent accounting and finance principles.</li> <li>Experience working with insurance carriers.</li> <li>Experience with employee benefits and compensation.</li> <li>Experience with the principles set forth in the NLRA would be helpful.</li> </ul> <p><b><i>Skills</i></b>:</p> <ul> <li>Highly efficient time management skills and ability to work effectively to meet deadlines in a rigorous business environment with a demanding case workload.</li> <li>Excellent written and oral communication skills, interpersonal, and leadership skills.</li> <li>Able to command the trust and respect of the General Counsel, Vice President &amp; Deputy General Counsel, other attorneys, and business managers and team members at all levels.</li> <li>Intellectually bright and curious, exercises great judgment and thinks strategically.</li> <li>Independent self-starter with highly effective analytical and problem-solving skills</li> <li>Strong sense of organization and attention to detail.</li> <li>An individual with high ethical standards whose opinions and advice are sought and respected.</li> <li>Able to work with team members, drawing on their strengths to achieve a common goal.</li> </ul> <p><b>Pay and Benefits Disclosure</b><br> The salary range for this role is $160,000 - $200,000 and is based on experience and qualifications. Certain roles are eligible for a 35% annual bonus. These awards are allocated based on company and individual performance. We offer employees access to healthcare benefits, a 401(k) plan and company match, short term and long term disability coverage, life insurance, wellbeing benefits and paid time off among others. Employees accrue up to 120 hours in their first year. Your accrual rate increases after your first year.
