Our attorneys manage enforcement case files, independently prosecute cases, serve as hearing officers, conduct legal research on complex matters of insurance law, and provide general legal support to the rest of the Department. Such prosecution includes conducting and preparing direct and cross-examinations, opening and closing statements, and settlement negotiations, as well as conferring with other Divisions at the Department of Insurance, witnesses, other attorneys, and other government officials.</li> <li>Serve as hearing officer on behalf of the Director for the Department.</li> <li>Occasionally provide public presentations to consumer, agent, and industry groups.</li> <li>Participate in the adoption and amendment of insurance laws and Department regulations and may, subject to approval by the Director and General Counsel, be assigned to participate in various task force, committee, and sub-committee meetings with the National Association of Insurance Commissioners (NAIC).</li> <li>Assist the Deputy Director/General Counsel and other Department personnel as needed.</li> <li>Other duties as assigned within the scope of the classification. #CB</li> </ul> </div> </div> <div> <b>Qualifications / Requirements</b> </div> <div> <div> Attorney I: Graduation from an accredited school of law and admission to the Nebraska Bar. <br> <br> Attorney II: One year of experience as an attorney practicing law and providing legal services such as preparing cases, <br> advising clients, and/or interpreting laws or administrative policies. <br> <br> Attorney III: Three years of experience as an attorney practicing law and providing legal services such as preparing and trying cases, advising clients, and/or interpreting laws or administrative policies. In accordance with Section 7-101, Nebraska Revised, Reissued Statutes of l943, incumbents in this class must be admitted to the Nebraska Bar. <br> <br> <b>Please submit a writing sample and three references along with the application.</b> <br> <br> Preference will be given to candidates that possess a combination of the following preferred experience/qualifications: <br> <ul> <li>Experience working in or regulating the insurance industry</li> <li>Litigation or other demonstrated experience in in interpreting insurance laws</li> <li>Familiarity with the Nebraska Administrative Procedures Act</li> <li>Experience serving as an administrative hearing officer</li> </ul> <br> Other: Candidates who have obtained a Juris Doctor degree but are not licensed to practice law in Nebraska may be considered for provisional employment for up to six months. Any such provisional employment must occur within or coincide with a probationary period in accordance with Title 273, Nebraska Administrative Code, Chapter 6. Licensure to practice law in the state of Nebraska must be obtained within the probationary period for continued employment.
