<p></p> <p><b>Position Description</b></p> <p> The Senior Counsel – Employment has responsibility for providing legal advice to the Company on issues affecting hiring, termination, employment practices, workplace policies, and employment disputes. The lawyer functions as a key strategic advisor to the Human Resources team, and to executive management, on all employment related matters, helping the Company manage the legal and reputational risks associated with employment related practices.</p> <p><b> Position Accountabilities</b></p> <p> The job duties of the Senior Counsel – Employment include:</p> <ul> <li>Provide legal and strategic advice on a broad range of employment related matters including performance management, workplace accommodations, wage and hour law, policies regarding discrimination, harassment, and retaliation, internal investigations, pay equity, incentive pay, terminations, severance, recruiting, whistleblower claims, and more.</li> <li>Collaborate with the Human Resources team on the development, implementation, interpretation, and application of workplace policies and procedures impacted by legislation such as FMLA, ADA, FLSA, OSHA, ERISA, and Title VII, and state employment laws relating to discrimination, workplace safety, and wage and hour. Manage legal risk in these areas and help ensure best practices and compliance with applicable laws and regulations.</li> <li>Provide legal and strategic advice to executive management on employment law matters for successful execution of company initiatives.</li> <li>Draft, revise, and advise internal partners on employment agreements, offer letters, non-compete agreements, confidentiality agreements, and separation agreements.</li> <li>Collaborate with the Human Resources team to generate and implement trainings on a broad range of employment-related topics.</li> <li>Oversee the hiring, quality and cost effectiveness of work of all legal counsel hired to represent the Company on employment matters.</li> <li>Conduct or manage confidential internal investigations on personnel matters. Respond to claims, demands, and inquiries on personnel matters from a wide variety of federal, state, and local agencies, including the Equal Employment Opportunity Commission (EEOC) and Department of Labor (DOL). Draft position statements and other submissions responding to such claims, demands, and inquiries. Where appropriate, negotiate resolutions.</li> <li>Collaborate with other lawyers on the Legal team to defend employment related litigation. Assess strengths and weaknesses of claims and develop strategies for individual litigation matters.</li> <li>Assist the Human Resources team in monitoring and interpretation of state employment and labor law developments in states where the Company has personnel.</li> <li>Provide legal and strategic advice to the Human Resources team on, and assist in drafting of, incentive compensation plans, programs, and policies.</li> <li>Provide legal and strategic advice to the Human Resources team regarding the company’s contingent and temporary workforce.</li> <li>Provide support for other legal functions as needed, such as contract review, negotiation of disputes, advice on subpoenas, liens, and garnishments, and a wide array of transactions.</li> <li>Provide legal advice and support on other legal matters affecting the Company as assigned.</li> <li>Apply sound ethical judgment in execution of all duties and responsibilities.</li> <li>Promote and demonstrate compliance with all legal and regulatory requirements, as well as the policies and procedures of the Company.</li> <li>Act independently and proactively without direction from internal or external legal counsel, evidencing good judgment on difficult issues.</li> </ul> <p><b>Organizational Relationship</b></p> <br> <p><b> </b></p> <p>The Senior Counsel – Employment reports to the General Counsel.</p> <br> <p></p> <p><b> Position Qualifications</b></p> <p><br> Education &amp; Experience</p> <ul> <li>Minimum of 8 years of experience as a practicing employment attorney in private practice or in a public company in-house counsel role</li> <li>Licensed Attorney in good standing admitted to practice in Virginia or able to satisfy corporate counsel/license transfer requirements. Additional bar admission and licensing in Maryland, New York, or North Carolina is beneficial.</li> <li>Completion of accredited Law School with degree (J.D.) from top 100 law school</li> <li>Completion of four years of college undergraduate study with degree</li> <li>Demonstrated extensive knowledge of U.S. employment and labor laws and regulations, including FMLA, ADA, FLSA, OSHA, ERISA, and Title VII.</li> </ul> <br> <p></p> <p> Knowledge &amp; Skills</p> <ul> <li>Ability to manage multiple projects and work successfully in a fast-paced environment with minimal supervision</li> <li>Excellent written and verbal advocacy skills</li> <li>Excellent analytical skills</li> <li>Excellent interpersonal skills; ability to interact effectively with a wide range of stakeholders</li> <li>Attention to detail and ability to remain organized</li> <li>Ability to work collaboratively and contribute to team goals</li> <li>Business orientation; ability to be creative and provide practical solutions</li> <li>Ability to prepare and deliver presentations</li> <li>Ability to use PowerPoint, Excel, Word, and other standard business programs</li> <li>Highest degree of adherence to ethical standards</li> </ul> <br> <p></p> <p><b> Salary offered will be based on several factors including but not limited to education, work experience, certifications, etc. This position is also eligible to participate in either an applicable incentive compensation plan for the position or a discretionary profit-sharing bonus program.
