Our actions create an inclusive, open and collaborative workplace that encourages diverse perspectives in all interactions.</p> <p><b><i><br> This position is located at our Fort Worth, Texas corporate office and has the potential to be a hybrid position with up to 50% remote work.</i></b></p> <p></p> <p><b><br> DUTIES &amp; RESPONSIBILITIES:</b></p> <ul> <li> This position will supervise discovery matters in railroad litigation, including general claims, and other disputes.</li> <li> Should be knowledgeable in the following areas of law: discovery, including e-discovery and related motion practice, Federal Employers Liability Act, grade crossing litigation, trespasser claims, occupational claims, toxic tort, indemnity and insurance.</li> <li> Assist with development of defense strategies for BNSF.</li> <li> Duties also include supervision of Outside Counsel; liaison with General Claims Department; development of trial strategy and tactics; preparation of witnesses for deposition, responding to subpoenas, motions to compel and demands for indemnity; and other litigation matters.</li> <li> Provide legal advice / consult on records and information retention issues as it relates to litigation.</li> <li> This person will also perform other litigation-related duties as assigned. Good communication and interpersonal skills are essential, as this person must interact with personnel from all levels of the Company.</li> </ul> <p></p> <p><b><br> QUALIFICATIONS:</b></p> <ul> <li> Qualified candidates must have a graduate or bachelor’s degree, Juris Doctor, and current law license (Texas preferred, but not mandatory); Must be able to obtain a Texas Bar license within one year of hire 2+ years of relevant work experience as a practicing lawyer (in-house, law firm or government) with litigation experience, with personal injury litigation or relevant railroad legal experience preferred.</li> <li> Candidate should possess strong negotiation skills and ability to build consensus and communicate compelling legal/business justification for position.</li> <li> Must possess excellent legal research, verbal and written communication skills and ability to handle complex and challenging assignments with extremely short turnaround deadlines.</li> <li> Candidate should possess knowledge of Microsoft Office365 Suite, Lexis/Nexis research system and other web-based legal research tools.</li> <li> Experience writing and arguing sophisticated motions and briefs; taken and defended depositions, to include experts; conducted investigations, and has made court appearances.</li> <li> Trial experience is preferred.</li> <li> Resume, references, non-confidential writing samples, and law school transcript may be required</li> </ul> <p><b><br> BENEFITS</b></p> <p> BNSF offers competitive benefit programs and services including, but not limited to</p> <ul> <li> Medical, Dental and Vision Coverage</li> <li> 401(k) Plan</li> <li> Railroad Retirement</li> <li> Life Insurance</li> <li> Incentive Compensation Plan (ICP)</li> <li> Tuition Reimbursement Program</li> </ul> <p><b> BACKGROUND INVESTIGATION ELEMENTS</b></p> <ul> <li> Criminal history</li> <li> Last 7 years of driving history</li> <li> Last 5 years of employment history to include military service</li> <li> Social Security number</li> <li> Education</li> </ul> <p><b> MEDICAL REVIEW ELEMENTS:</b></p> <ul> <li> Medical evaluation</li> <li> Drug Screen</li> <li> Other elements as needed</li> </ul> <p><b> DRUG TEST ELEMENTS:</b></p> <p> BNSF is committed to a safe and drug free work place and performs pre-employment substance abuse testing.
