This role will lead the employment law function at TriWest, providing counsel and advice in support of the company’s operations. This attorney will be a key strategic advisor to Human Capital department and other business leaders to solve challenges, and proactively provide counsel and training in employment law and benefits subject matters. Offers expert advice regarding matters including hiring, termination, reductions in workforce, discrimination/harassment/retaliation, restrictive covenants, conduct and discipline, disability, leave, workplace accommodations, benefits (ERISA, health plan and retirement plan compliance) and related issues. Experience with federal government (DoD and/or VA, especially) contractors is preferred.</p> <p><b><i> **Veterans, Reservists, Guardsmen, and military family members are encouraged to apply**</i></b></p> <p><b> Education &amp; Experience</b></p> <p></p> <p><b> Required</b></p> <ul> <li> Juris Doctor degree from an accredited law school</li> <li> Licensed and in good standing to practice law in a U.S. State or D.C.</li> <li> 5+ years legal experience in a medium to large law firm, or in-house in a corporate or government entity</li> <li> Knowledge of and experience with US employment laws, counseling, and investigations</li> <li> Excellent written and verbal communication skills; negotiation, and ability to drive results</li> <li> Ability to provide timely and responsive legal support for business contacts located in the Mountain time zone</li> </ul> <p><b> Preferred</b></p> <ul> <li> Familiarity with laws and regulations specific to federal government contractors (i.e., Service Contract Act)</li> <li> Experience advising US federal government contractors regarding conflicts of interest issues</li> <li> Experience advising managed care administrators, health plans or healthcare providers</li> <li> Extensive experience with contract clauses, including intellectual property terms and general business terms, with the ability to successfully review and negotiate appropriate contractual terms</li> <li> Familiarity with FAR and DFARS clauses</li> </ul> <p><b> Key Responsibilities</b></p> <p></p> <p><b> TriWest Associate General Counsel:</b></p> <ul> <li> Provide day-to-day advice and counseling to the Human Capital team and the business on a range of employment-law related issues such as performance management and terminations, leaves of absence / accommodations, investigating claims, and DEI, among other areas, within a variety of US jurisdictions.</li> <li> Assist in the preparation of responses to charges or complaints filed with administrative agencies such as the EEOC, OFCCP, or state agencies.</li> <li> Provide support and direction to outside counsel as-needed on employment-law related claims and litigation.</li> <li> Counsel and advise on TriWest’s response to Department of Labor, OFCCP, or state agency audits of employment or personnel related matters.</li> <li> Help with OFCCP and pay data reporting obligations in the US, in collaboration with the Human Capital, Finance and Payroll teams.</li> <li> Advise on internal investigations in consultation with Human Capital.</li> <li> Identifies and analyzes legal issues (including conducting legal research, identifying new or emerging areas of risk, etc.), presents clear recommendations, and ensures legal compliance.</li> <li> Assist in the response to other legal matters as needed, applying knowledge of legal processes and procedures, including subpoenas and discovery.</li> <li> Provides direction to Paralegal/Legal Assistants and Payroll team regarding the handling of employee wage garnishments, tax levies, and similar.</li> <li> Investigates, researches and provides general legal advice on a broad range of issues arising from TriWest operations.</li> <li> Assists in providing legal advice to departments and committees throughout TriWest as assigned; including monitoring of legislative/regulatory developments and proactively advising internal clients (alerts) of new requirements or risks.</li> <li> Reviews and develops other documents, correspondence, and contracts as necessary.</li> <li> Collaborates with colleagues across the TriWest legal department.</li> <li> Researches current issues and developments related to the assigned legal subject matter.</li> <li> Assists with the development and monitoring of internal regulatory compliance procedures.</li> <li> Reviews routine and priority correspondence, and internal and external communications documents in areas of responsibility.</li> <li> Functions on TriWest standing and ad hoc committees as a representative of the Legal department as assigned.</li> <li> Assists with TriWest training and implementation to ensure legal compliance with requirements.</li> <li> Reviews and revises Company policies and procedures to ensure that they are clear, modern, and follow best practices, and communicated effectively to all employees.</li> <li> Ensures that Company employees and committee members are aware of and in compliance with applicable laws and regulations.</li> <li> Educates staff and committee members on legal requirements as appropriate.</li> <li> Advises TriWest senior leadership of the legal ramifications of past and proposed company actions.</li> <li> Performs other duties as assigned.</li> <li> Regular and reliable attendance is required.</li> </ul> <p><b> Competencies</b></p> <p><b> Technical Skills</b></p> <p> Comprehensive knowledge of area of legal practice and broad management knowledge of other professional areas to carry out objectives.</p> <p><b> Problem Solving / Analysis</b></p> <p> Ability to solve problems through systematic analysis of processes with sound judgment;
