<div id="jobDescriptionText" class="jobsearch-jobDescriptionText"><div> <div> The Legal team is responsible for managing the legal affairs of the company, including providing legal counsel across the organization, handling disputes, and creating and enforcing intellectual property. </div> <div></div> <div> Let's Talk About the Team and You: </div> <div> The primary role of the Corporate Counsel, Technology function is to provide advice and counsel to our clients, including technical teams, digital product teams, and business leaders, as well as our legal colleagues, on technology and data as the foundation for ResMed’s continuing transition from a medical device company with outstanding technology, to a technology company with outstanding devices. You will have deep knowledge in guiding the business as we build our tech stack—layers of data that our data scientists will use to create new and exciting products for our customers in health care—providers, physicians and patients. You will need to be deeply conversant with applicable privacy laws and the intersection of technology and privacy. Our teams are using artificial intelligence, machine learning and biometrics as we build new products for global use. </div> <div></div> <div> The tech stacks we have built and are building will be the core foundation for the digital products that ResMed offers, so “getting it right” is very important. You will be a key participant in that effort. </div> <div></div> <div> Essential duties include proactive legal guidance to facilitate the launch of new and innovative technology products and service models, while ensuring that privacy, data security and data protection, and anti-kickback laws affecting medical device manufacturers and digital health are properly addressed by our legal and privacy teams. The successful candidate will be able to work collaboratively with both business leaders and other members of the legal team inside and outside the United States to further ResMed’s business and legal interests in these important areas. </div> <div></div> <div> Let’s Talk about Responsibilities: </div> <ul> <li> Advice to our technical teams in different parts of the world as we build the technical foundations that we all use to create products that provide bridge the divide between devices and the software that helps our customers and our patients drive effective treatment of respiratory care.</li> <li> Work with the business to “future proof” our technical resources so that we can build offerings that can be scaled across the globe, and across different markets—B2B, B2B2C, and B2C.</li> <li> Provide legal advice on data analytics, digital health, and projects involving data processing, licensing, biometrics, artificial intelligence and machine learning.</li> <li> Track latest laws and regulations and proactively determine opportunity or impact on ResMed’s digital health strategy and business models.</li> <li> Advise legal department contracts team on agreements involving complex or highly technical subject matter, particularly in the area of data, data sources, digital health, software licenses, cloud technology, software as a service, and other technology contracts.</li> <li> Interact with management and/or major customers and strategic collaborators (e.g. EHR, big tech and health service companies). Interactions frequently involve special skills, such as explaining, advising and influencing senior level leaders, particularly with respect to privacy and compliance issues.</li> <li> Knowledge of licensing, cloud-based and platform as-a- service agreements, and contract management, among other topics.</li> <li> Strong working knowledge of HIPAA, CCPA, CPRA, biometrics legislation, 21st Century Cures Act -The Information Blocking Rule, working knowledge of PIPEDA, LGPD, the GDPR and other privacy laws; data security; use of de-identified data and other data issues applicable to data used to drive excellent healthcare.</li> <li> Spot issues that can implicate compliance with anti-kickback and other relevant laws.</li> <li> Collaborate with information security and privacy team on the risk of potential data breach breaches.</li> <li> Work closely with and support leaders in the Digital Health Technology, Product Management, Intellectual Property, and SaaS legal teams, particularly those located in North America, to ensure alignment of commercial, compliance, and regulatory goals.</li> <li> Coordinate activities with global counterparts to deliver repeatable and predictable legal advice to global commercial lawyers.</li> <li> Supervise outside counsel on issues and projects outsourced by the legal department, principally in privacy and digital health software and tools to drive patient compliance.</li> <li> Focus on development and implementation of strategic and operational objectives that help achieve organizational mission and departmental goals.</li> <li> Contribute to and manage projects involving the legal and compliant use of personal data.</li> </ul> <div></div> <div> Let’s talk about Qualifications and Experience: </div> <ul> <li> Bachelor’s degree, law degree from accredited law school, eligible for California in-house registration.</li> <li> Minimum 7 years of experience in technology related businesses, technology agreements, digital health software, privacy, compliance, and healthcare law.</li> <li> Easily recognized as a “tech lawyer” based on your experience, training, and accomplishments.</li> <li> One or more International Association of Privacy Professionals, CIPP/US credential, or a similar certification preferred.</li> <li> Experience analyzing and responding to incidents and HIPAA breaches strongly preferred.</li> <li> Looks beyond existing methodologies and own discipline to define and resolve complex problems by thinking practically, has in-depth knowledge of organizational objectives.</li> <li> Demonstrated versatility, curious to tackle and learn matters outside of expertise, and sound judgment.</li> <li> Sound cross-functional collaboration, ability to strategically prioritize, keep up with a fast-paced entrepreneurial type of environment.
